  भारत के उत्तराखंड में घर खरीदने के लिए विभिन्न नियमों और विनियमों का पालन करना आवश्यक है। यहाँ कुछ महत्वपूर्ण बिंदुओं पर विचार किया गया है





भूमि स्वामित्व: उत्तराखंड में भूमि स्वामित्व भूमि अधिग्रहण अधिनियम, 1894, उत्तराखंड भूमि राजस्व अधिनियम, 1901 और उत्तराखंड जमींदारी उन्मूलन और भूमि सुधार अधिनियम, 1954 द्वारा शासित है। भूमि के स्वामित्व और संपत्ति के शीर्षक को सत्यापित करना महत्वपूर्ण है। घर खरीदने से पहले।

बिल्डिंग अप्रूवल: उत्तराखंड में किसी भी बिल्डिंग के निर्माण से पहले बिल्डिंग अप्रूवल और क्लीयरेंस जरूरी है। अनुमोदन प्रक्रिया में स्थानीय प्राधिकारियों से अनापत्ति प्रमाणपत्र (एनओसी), वन विभाग से अनापत्ति प्रमाणपत्र (यदि लागू हो) और प्रदूषण नियंत्रण बोर्ड से प्रमाणपत्र प्राप्त करना शामिल है।

संपत्ति पंजीकरण: उत्तराखंड में सभी संपत्ति लेनदेन को स्थानीय उप-पंजीयक कार्यालय में पंजीकृत होना चाहिए। पंजीकरण प्रक्रिया में स्टांप शुल्क और पंजीकरण शुल्क का भुगतान, और बिक्री विलेख, एनओसी, निकासी प्रमाण पत्र आदि जैसे विभिन्न दस्तावेज जमा करना शामिल है।

स्वामित्व का हस्तांतरण: विक्रेता से खरीदार को संपत्ति के स्वामित्व का हस्तांतरण बिक्री विलेख के माध्यम से किया जाता है। विक्रय विलेख गैर-न्यायिक स्टाम्प पेपर पर निष्पादित किया जाना चाहिए, और प्रचलित दरों के अनुसार स्टाम्प शुल्क का भुगतान किया जाना चाहिए

करों का भुगतान: उत्तराखंड में संपत्ति के मालिकों को प्रचलित दरों के अनुसार संपत्ति कर, स्टांप शुल्क, पंजीकरण शुल्क और पूंजीगत लाभ कर (यदि लागू हो) जैसे विभिन्न करों का भुगतान करना आवश्यक है।

विदेशी खरीदार: विदेशी खरीदारों को उत्तराखंड में संपत्ति खरीदने की अनुमति है, जो भारतीय रिजर्व बैंक (आरबीआई) से अनुमोदन के अधीन है। आरबीआई विदेशी नागरिकों को कुछ शर्तों के अधीन भारत में आवासीय और वाणिज्यिक संपत्ति खरीदने की अनुमति देता है।

रियल एस्टेट नियामक प्राधिकरण (आरईआरए): उत्तराखंड रियल एस्टेट (विनियमन और विकास) अधिनियम, 2016, उत्तराखंड रियल एस्टेट नियामक प्राधिकरण (आरईआरए) के साथ सभी रियल एस्टेट परियोजनाओं के पंजीकरण को अनिवार्य करता है। रियल एस्टेट क्षेत्र में पारदर्शिता और जवाबदेही सुनिश्चित करने और घर खरीदारों के हितों की रक्षा के लिए रेरा जिम्मेदार है।
